The State of Queensland acting through the Department of Science, Information Technology, Innovation and the Arts (“the Department”) requires you (“the User”) to read and agree to abide by the following TERMS AND CONDITIONS OF USE before proceeding.
The Department reserves the right to alter its terms and conditions without prior notice.
The I Choose Technology suite of templates includes banners, posters, postcards, flyers, PowerPoint presentation slides, photographs, illustrations, maps, logos and design elements (“the Promotional Material”).
By accessing the I Choose Technology Promotional Material, you agree to be bound by these terms and conditions.
1. Ownership of the Promotional Materials of this Website
a. The I Choose Technology is Promotional Material is owned by the Department.
b. All intellectual property rights including all copyright, patents, trade marks, designs, trade secrets, know-how and other like rights in the Promotional Material remain vested at all times in the Department and will not by virtue of this Agreement be transferred to the User.
2. Licence to Use
The Department grants to the User a non-transferable, non-exclusive licence, to use, reproduce, adapt, communicate, publish and modify the Promotional Material subject to the terms of this agreement including the Rules and Restrictions outlined below.
3. Rules and Restrictions
a. The User may only use and reproduce the Promotional Material as specified in the visual style guide contained on the I Choose Technology website (“Visual Style Guide”).
b. The User must not significantly alter the overall design and brand of the Promotional Material nor use the Promotional Material in a manner which is inconsistent with the Visual Style Guide.
c. The User may use the text and images provided in the Visual Style Guide or insert the User’s own images and information in the space provided in the Promotional Material templates as outlined in the Visual Style Guide.
d. The User must only use the Promotional Material and the text and images provided in the Visual Style Guide to promote the diversity and vast opportunities offered through an ICT career or study options. The User must not use the Promotional Material and the text and images provided in the Visual Style Guide for any other purpose without the prior written consent of the Department.
e. Subject to sub-clause d. above, the User may use the Promotional Material for the production of marketing collateral such as brochures, postcards, pamphlets, posters and electronically such as on websites or PowerPoint presentations.
f. The User may add its logo or insignia directly on the Promotional Material, however the inclusion of such logos or insignia will not imply endorsement of the User or its organisations and activities by the Queensland Government.
g. If the User intends to use or reproduce the Promotional Material it must provide examples of the intended use to the Department no less than three weeks before public use or publication and the User agrees to comply with any directions made by the Department regarding the use of or alteration of the Promotional Material before public use or publication. The User must provide the Department copies of any published Promotional Material within three weeks of public use or publication. This is to apply any time the Promotional Material is reproduced or reissued.
h. The User acknowledges that its use of the Promotional Material may be publicised or published by the Department.
i. The User may not commercialise, sub-license or sell the Promotional Material to third parties.
j. The Department reserves the right at any time to refuse to allow the Promotional Material and its intellectual property to be used by the User in a manner which is inconsistent with Departmental policy or where the Promotional Material is being used to promote products and organisations that conflict with the Department’s values.
k. The Department reserves the right to restrict access to the Promotional Material at any time for any reason without notice.
4. User’s Risk
a. The Department will not be liable for technical or other errors or omissions contained within the Promotional Materials.
b. The User accepts all risks and responsibility for and releases the Department from and against all claims, losses, damages, costs and other consequences resulting directly or indirectly from the use of this site or any of the Promotional Material.
c. The Department does not warrant, guarantee or make any representations regarding the correctness, accuracy, reliability or use of the Promotional Material.
